1.1 These Terms and Conditions ("Terms") apply to all heating, cooling, plumbing, electrical, duct cleaning, fireplace and related services, equipment sales and installations provided by Affordable Comfort Ltd. ("Affordable Comfort", "we", "us", "our") to you, the customer ("you", "your").
1.2 Your agreement with us is made up of your signed estimate, work order, invoice or contract ("Signed Documents"), the Comfort Club Membership Agreement if you are a member, and these Terms. If they conflict, your Signed Documents govern first, then the Comfort Club Membership Agreement, then these Terms. Where a Signed Document is silent on a matter, these Terms apply.
1.3 By signing an estimate or invoice, authorizing work, making a payment, or allowing our technicians to begin work, you accept these Terms.
1.4 Nothing in these Terms limits any right you have under Ontario consumer protection legislation or any other law that cannot be waived by agreement. If any part of these Terms conflicts with such a law, the law applies to that part and the rest of these Terms remain in effect.
2.1 Quotes are valid for 7 days and are subject to change without notice due to fluctuating material costs, including government-imposed tariffs. Pricing is not guaranteed until your deposit is received.
2.2 Estimates are based on the conditions visible at the time of our assessment. Hidden or unforeseen conditions, such as concealed piping, wiring or ductwork, damaged or undersized ductwork or venting, insufficient electrical capacity, pre-existing code deficiencies, or hazardous materials, may require additional work at additional cost. We will explain the additional work and obtain your approval before proceeding, except where immediate action is needed for safety.
2.3 Diagnostic and service call fees cover technician travel, assessment and recommendations. Repairs, parts and additional work are billed separately.
2.4 After-hours, weekend and emergency service is subject to technician availability, and additional rates may apply. Applicable rates will be disclosed before work begins.
2.5 We may help you apply for rebates or incentive programs, but we cannot guarantee approval, the amount, or the timing of any rebate. Program rules are set by the program administrator. You are responsible for paying your invoice in full regardless of the outcome of a rebate application.
3.1 For equipment installations and special-order work, a deposit of 50% of the estimated price is required before equipment or materials are ordered. The remaining balance is due upon completion. Special orders and customers with high-risk credit situations may be required to pay in full in advance.
3.2 If the law gives you a cooling-off period (for example, for certain agreements made in your home), you may cancel within that period and receive any refund the law requires. After that period, we may retain from your deposit the costs we have incurred, including special-order equipment, restocking fees and work already completed.
3.3 Unless your Signed Documents state otherwise, payment is due upon completion of the work and receipt of your invoice. Accepted payment methods are listed on your estimate or invoice. A service fee applies to returned or dishonoured payments.
3.4 Interest is charged on overdue balances at 2% per month, compounded monthly (26.82% per year).
3.5 Equipment and materials supplied by us remain our property until paid in full. To the extent permitted by law, if payment is not made, we may remove equipment and materials we supplied, and we are not responsible for damages resulting from their removal.
3.6 Affordable Comfort's labour warranties and guarantees (Sections 5 and 9), and any Comfort Club extended warranties, take effect only when your invoice is paid in full. If the balance is not paid in full within 30 days of the installation date or invoice date, whichever is sooner, those warranties are void. This does not affect manufacturer warranties or any rights you have under law.
3.7 Financing is offered on approved credit through third-party financing partners on select equipment and services. Eligibility, terms, payments and fees are set out in your financing agreement. Affordable Comfort is not the lender and is not responsible for decisions made by the financing provider.
4.1 Appointments are scheduled within an arrival window. We will notify you if a technician will be late. Weather, emergencies, traffic and parts availability can cause delays, and we are not liable for losses resulting from delays in diagnosing, servicing or repairing your equipment.
4.2 You agree to provide safe, clear access to the work area, equipment, electrical panel and water shut-offs, to secure pets, and to have an adult present who can authorize the work. Additional time caused by access issues may be charged.
4.3 We may stop work, cancel scheduled appointments and decline to provide further service where conditions are unsafe, or where the conduct of a customer or any person at the premises toward our staff is aggressive, abusive, harassing, threatening, discriminatory or otherwise unreasonable, in person or through any form of communication. This includes conduct toward our technicians, office staff, subcontractors and anyone else working for us, whether in person, by telephone, by text message, by email, or through any other form of communication. Where that happens we may also cancel any outstanding estimate, work order or agreement, end any Affordable Comfort labour warranty, guarantee or membership for that customer, and decline to do business with that customer in the future, other than rights that cannot be waived under applicable law. Charges for work already completed remain payable, and we will refund any amount you have paid for work we have not performed. We are committed to a respectful and safe working environment for everyone involved.
4.4 We do not test for or remove asbestos, vermiculite, mould, lead or other hazardous materials. If we suspect hazardous materials, we will stop work until they are assessed and, if necessary, removed by a qualified professional at your cost.
4.5 Some work requires cutting or opening drywall, ceilings or flooring. Unless your estimate specifically includes it, patching, painting and finishing are not included. We take care to protect your home, but we are not responsible for damage to materials that were already weak, brittle or deteriorated, or to items not moved away from the work area.
4.6 Where a permit, notification or inspection is required for our work, you agree to give us and the inspecting authority access to your home. Corrections required because of pre-existing conditions are not included in our price.
4.7 Loaner equipment, such as portable air conditioners and space heaters, remains the property of Affordable Comfort. You must use it according to the instructions provided and return it in the same condition, excluding normal wear. You are responsible for loss of or damage to loaner equipment while it is in your care.
5.1 What it covers. Our workmanship warranty covers defects in the work we perform, meaning problems caused by the way we installed or repaired something. During the warranty period we will correct those defects at no charge for labour. It does not cover the equipment or parts themselves, which are covered only by the manufacturer's warranty (Section 6).
5.2 Warranty period.

5.4 Our obligation is limited to repairing or redoing the affected work, at our option. Except where required by law, no cash refunds or credits are provided under this warranty.
5.5 If we attend a warranty call and find the problem is not covered, for example because it was not caused by our workmanship, falls under an exclusion in Section 7, or no fault is found, our standard diagnostic or service call fee and any repair charges apply.
5.6 Warranties apply to the original service address and are not transferable unless your Signed Documents state otherwise.
5.7 Conduct and safety. We provide our warranties and guarantees on the condition that our people are treated with respect. Warranties and guarantees provided by Affordable Comfort under these Terms are void if you, any person at the premises, or anyone acting on your behalf behaves toward our technicians, office staff, subcontractors or anyone else working for us in a way that is unsafe, aggressive, abusive, offensive, threatening, harassing or discriminatory, whether in person, by telephone, by text message, by email, or through any other form of communication. They are also void if we are denied safe access to carry out warranty work. In these circumstances we may also decline to provide any further service and end our relationship with you, as set out in Section 4.3. This does not affect the manufacturer's warranty or any right that cannot be waived under applicable law.
6.1 Equipment and parts are covered only by the manufacturer's warranty, on the manufacturer's terms. The manufacturer decides whether a claim is approved. Affordable Comfort does not extend or guarantee manufacturer warranties except as set out in Section 9 or in the Comfort Club Membership Agreement.
6.2 Many manufacturers require registration within a set period after installation to receive full warranty coverage. Unless we confirm in writing that we have registered your equipment, you are responsible for registering it.
6.3 When a part is replaced under a manufacturer's warranty after our labour warranty period has ended, the labour, refrigerant, materials, diagnostic fees and warranty processing fees are charged to you, even though the part itself is covered.
6.4 Some parts must be ordered from the manufacturer or a supplier, which may cause delays beyond our control. If a part is obsolete or unavailable, we will make commercially reasonable efforts to provide a suitable substitute, but we are not responsible for replacing the equipment.
Unless the law requires otherwise, no Affordable Comfort warranty or guarantee covers problems caused by or related to:
8.1 These Terms apply to all customers, including Comfort Club members.
8.2 Comfort Club membership benefits, including the 15-Year True Comfort Parts and Labour Warranty and the True Comfort Lifetime Repair Guarantee, are set out only in the Comfort Club Membership Agreement. Those benefits apply only to active members in good standing and are governed by that agreement.
8.3 Customers who are not Comfort Club members receive only the warranties described in these Terms and the manufacturer's warranty.
9.1 If the compressor or heat exchanger of a new furnace, air conditioner or heat pump supplied and installed by Affordable Comfort fails due to a manufacturing defect within 1 year of the installation date, we will replace the unit with a new unit of the same or a comparable model at no charge.
9.2 Conditions: your invoice must be paid in full; the equipment must be registered with the manufacturer; the failure must not fall under an exclusion in Section 7; and one replacement is provided per system. Ductwork, line sets, accessories and upgrades are not included.
10.1 To the maximum extent permitted by law, our total liability for any claim relating to our products or services is limited to the amount you paid for the specific work that gave rise to the claim.
10.2 To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, including water damage, frozen or burst pipes, mould, food or medication spoilage, hotel or temporary accommodation costs, lost income, or loss of use of your equipment or home.
10.3 We are not liable for work performed by anyone other than Affordable Comfort, or for losses resulting from delays or from equipment that cannot be repaired because parts are obsolete or unavailable.
10.4 Nothing in this Section limits any liability that cannot be limited or excluded under applicable law.
Energy savings, efficiency, operating cost and comfort estimates are based on typical conditions and are not guaranteed. Actual results depend on factors such as insulation, air leakage, ductwork, thermostat settings, usage and utility rates.
Products purchased through our online store are subject to our Return & Exchange Policy and Shipping Policy. Products purchased without installation by Affordable Comfort are covered only by the manufacturer's warranty. We provide no workmanship warranty for products installed by you or anyone else, and improper installation may void the manufacturer's warranty.
13.1 We may update these Terms from time to time. The Terms in effect on the date of your signed estimate, contract or membership agreement apply to that job or membership term.
13.2 These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
13.3 If any part of these Terms is found invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of these Terms remain in full force.
